Psilocybin law in Nevada and Las Vegas

Nevada came close to decriminalizing psilocybin in 2023 and ended up creating a working group instead. No Nevada city has passed a local measure, and the Legislature doesn't meet again until 2027.

By Norshroom EditorsUpdated

Psilocybin is illegal under Nevada law. Possessing, growing, giving away and selling it are crimes, and no Nevada city or county has passed a decriminalization or lowest-priority measure.1 That includes Las Vegas, Henderson and Reno.1,3

The 2023 law that changed course

SB 242 started out in 2023 as a bill to decriminalize possession of psilocybin mushrooms. By the time it was approved on June 12, 2023, it had been rewritten. The final version created a Psychedelic Medicines Working Group to study psychedelic medicines and set procedures for approved research. It didn't change criminal penalties.1

Recent bills

In 2025, AB 378 would have set up an alternative-therapy pilot for veterans and first responders. It didn't pass.1,2 Nevada's Legislature meets every other year, so the next chance for a psilocybin bill is the 2027 session.1

What this means in Las Vegas

Las Vegas has no local measure of any kind, so psilocybin is treated the same as under state law: possession and sale are crimes, and Las Vegas Metropolitan Police and Clark County prosecutors can enforce them.1 Visitors sometimes assume Nevada's legal cannabis market covers mushrooms. It doesn't.

What remains illegal

Everything. Possessing, growing, sharing and selling psilocybin are illegal under Nevada law, and psilocybin is a Schedule I drug under federal law.1,4 Selling it is illegal under both state and federal law.

What to watch

  • Bills in the 2027 legislative session, including any return of a veterans' therapy pilot.
  • FDA action on COMP360. Compass Pathways expects to finish its FDA application in late 2026.5 An approved psilocybin medicine would still need DEA rescheduling before doctors could prescribe it. See the research tracker.
  • Whether any Nevada city follows the lead of cities in neighboring California and Colorado.
